The New York Civil Liberties Union has announced that it has filed a lawsuit challenging the decision of the U.S. Department of Education to include the system in the school system for the first time in its history. The lawsuit, which challenges the legality of the systems approved by the state Department of Education, was filed in U.S. District Court in Manhattan on behalf of former Sen. Jim DeMint (D-Manhattan) and his wife, Dr. Mary Ann D'Amato.

The only high school in the district is Lockport High School, which participates in both the New York State and New Jersey high school championships. It is the only public school district with a football and basketball team and hosts the state's only professional football team and the nation's second-largest basketball program.

The school is subject to Common Core State Standards, a standardized test developed and conducted under the direction of the New York State Education Department. The criteria used to get students to the teaching level are the average grade point average (GPA) and the number of credits in each of the Honors Level courses. The order of precedence of the classes is determined by the students descending from the highest to the lowest level of the order on a scale from 1 to 1. A weighted grade point average is calculated by weighting the marks and points of each student above or below the average for each course, weighted by 1.1 and 0.05 for the course at the honorary level, excluding mathematics and science.

It makes no sense for the NYSED to spend taxpayer money defending its decision to allow technology that could ultimately be banned in our schools.
